         Das denkmalgeschützte Deutschlandhaus wird saniert und teilweise durch Neubaumaßnahmen ergänzt um die Stiftung für Flucht Vertreibung und Versöhnung zu beherbergen. Als Teil der Baumaßnahme werden die ca. 2 000 m2 große Freianlagen neu gestaltet.

         Die Fläche wird vollflächig aus Gußasphalt ausgeführt. Die Gußasphaltfläche dient als Untergrund für ein im Nachgang zu errichtendes Kunstwerk bestehend aus ca. 1.8 Mio Nägeln, welche in die Deckschicht eingeschlagen werden.

         Die maßgeblichen Leistungen sind:

         — Restleistungen Abbruch,

         — ca. 240 m3 Bodenaushub,

         — ca. 10 m3 Betonfundament,

         — ca. 1 700 m2 Schottertragschicht,

         — ca. 1 700 m2 Asphalttragschicht,

         — ca. 1 700 m2 Asphaltbinderschicht,

         — ca. 1 700 m2 Gußasphaltdeckschicht,

         — ca. 50 m2 Mosaiksteinpflaster, Oberstreifen,

         — ca. 40 m2 Großsteinpflaster, Gehwegüberfahrt,

         — ca. 120 m Einfassung Stahlband,

         — ca. 160 m2 Erneuerung Belag auff Tiefgaragendecke, Sickerschicht, Verbundpflaster, gebunden verlegt,

         — 4 St. Lichtstelen einzubauen,

         Zuständig für die Nachprüfung von Vergabeverfahren ist das Bundeskartellamt- Vergabekammern des Bundes, Villemombler Str. 76, 53123 Bonn,

         Gemäß § 160 Abs. 3 Nr. 1 GWB müssen erkannte Verstöße gegen Vergabevorschriften innerhalb einer Frist von 10 Kalendertagen bei der Vergabestelle des Bundesamtes für Bauwesen und Raumordnung, Referat A 4, Straße des 17. Juni 112 in 10623 Berlin, gerügt werden, Verstöße gegen Vergabevorschriften, die sich aus diesem Bekanntmachungstext oder aus den Vergabeunterlagen ergeben, müssen innerhalb der Angebots- bzw. Bewerbungsfrist gerügt werden, § 160 Abs. 3 Nr. 2 GWB.

         Hilft die Vergabestelle der Rüge nicht ab, kann ein Antrag auf Nachprüfung beim Bundeskartellamt unter der o.g. Anschrift innerhalb von 15 Kalendertagen nach Eingang der Mitteilung des Auftraggebers, der Rüge nicht abhelfen zu wollen, gestellt werden. Der Nachrüftungsantrag ist unzulässig, soweit die Voraussetzungen von § 160 Abs. 3 GWB vorliegen.

         Die Vergabestelle weist ferner auf die Vorschriften der §§ 134, 135 GWB hin. Insbesondere sind die Fristenregelungen in § 135 Abs. 2 GWB zur Geltendmachung der in § 134 Abs. 1 GWB genannten Verstöße zu beachten.
