         Der Auftraggeber benötigt kurzfristig neun zusätzliche Busse, die insbesondere im Schülerverkehr eingesetzt werden sollen. Aufgrund einer Neufassung der Satzung des Landkreises Ludwigslust-Parchim wird im Herbst 2019 mit einem erheblichen Anstieg der Zahl der zu befördernden Schüler gerechnet. Im Hinblick auf die verfügbaren Haushaltsmittel für die Beschaffung von Fahrzeugen sollen gebrauchte Fahrzeuge beschafft werden, die aber nicht älter als ein Jahr sein sollen. Gegenstand des vorliegend bekanntgemachten Auftrags ist eine Teilbeschaffung (Lieferung von 7 gebrauchten Diesel-Niederflurbussen (3-Achser) zum Einsatz im Linienverkehr und im freigestellten Schülerverkehr.

         Nach § 135 Abs. 1 Nr. 2 GWB ist ein öffentlicher Auftrag von Anfang an unwirksam, wenn der öffentliche Auftraggeber den Auftrag ohne vorherige Veröffentlichung einer Bekanntmachung im EU-Amtsblatt vergeben hat, ohne dass dies aufgrund Gesetzes gestattet ist und dieser Verstoß in einem Nachprüfungsverfahren festgestellt worden ist. Die Vergabestelle ist der Auffassung, dass die Voraussetzungen für eine Auftragsvergabe ohne vorherige Veröffentlichung einer Bekanntmachung im Amtsblatt der EU vorgelegen haben (s. Anhang D zu dieser Bekanntmachung). Sollte ein Dritter der Auffassung sein, dass die Auftragsvergabe ohne vorherige Veröffentlichung einer Bekanntmachung im Amtsblatt der EU unzulässig gewesen ist, ist ein entsprechender Nachprüfungsantrag nach § 135 Abs. 2 Satz 2 GWB innerhalb von 30 Kalendertagen nach der Veröffentlichung dieser Bekanntmachung bei der zuständigen Vergabekammer (VI.4.1)) zu stellen.
